DMCA Policy

Pound Cake Recipe respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Pound Cake Recipe will respond expeditiously to claims of copyright infringement committed using the Pound Cake Recipe service and/or the Pound Cake Recipe website (the "Site") if such claims are reported to Pound Cake Recipe's Designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Pound Cake Recipe's Designated Copyright Agent.

Upon receipt of the Notice as described below, Pound Cake Recipe will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Filing a DMCA Notice of Alleged Infringement ("DMCA Notice")

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Site, please notify Pound Cake Recipe's copyright agent, as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:

An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
Identification of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Pound Cake Recipe to locate the material, including, at a minimum, if applicable, the URL of the link shown on the Site where such material may be found.
Information reasonably sufficient to permit Pound Cake Recipe to contact you, such as an address, telephone number, and, if available, an electronic mail address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Counter-Notification Procedures

If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Designated Copyright Agent identified above. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Pound Cake Recipe may be found, and that you will accept service of process from the person who provided the original DMCA notification of the alleged infringement.

The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter-Notice.
